Terms of Service

Version 1.0 · Effective 2026-10-05 · Provider: OpDesk · Site: https://opdesk.eu · Contact: support@opdesk.eu

1. Scope

These Terms govern OpDesk services: technical diagnosis and, where feasible and safe, repair of website / e-commerce issues (especially WordPress / WooCommerce and related PHP, themes, plugins), via secure access (SFTP/SSH or GitHub) and AI / automation tools.

Each engagement is limited to the Job you open in the product. Scope, price and repair recommendation are shown on the Job before you pay or approve changes.

2. Acceptance

By registering, using the platform, or accepting electronically before diagnosis/repair (checkbox, approve button or equivalent), you accept these Terms in the version shown at acceptance time.

We keep an acceptance record (user, Job, Terms version, stage, time, IP where available, and relevant Job details).

3. Authorization

You confirm you own the site or have full authority to grant access and request modifications.

You authorize OpDesk to perform only work related to that Job (diagnosis, file snapshot, proposed patch, apply after approval, checks, rollback where applicable).

You must not request work on third-party systems without permission, or use the service for malicious or unlawful purposes.

4. What we do not do without approval

We do not apply live changes without your explicit Job approval.

We do not place orders for you, change payment details, message your customers, or delete data unless required for the agreed fix and approved via the proposed diff.

We do not provide a full penetration test or security audit unless separately agreed.

5. Diagnosis and repair

Diagnosis is a separate fixed-price service (as shown in the product, currently €19). It is a technical assessment based on your inputs and the snapshot; it does not guarantee every possible cause was found.

If diagnosis recommends repair and you proceed, repair is charged separately (currently €70) for that Job’s scope. Out-of-scope work needs a new notice/approval.

If the issue turns out materially different or much more complex, we may pause and notify you before continuing.

6. Backups and No Fix, No Charge

Before applying live changes, where technically possible we create a file-level backup of the relevant web root / workspace, with restore available for a limited period (typically up to 30 days) via the product.

This backup mainly covers files we manage over SFTP/SSH; it is not a full database or hosting backup. You remain responsible for full hosting backups.

No Fix, No Charge (repair): if post-deploy automated checks fail and we roll back, we refund the repair fee. Diagnosis remains a separate charge and is not auto-refunded for that reason.

7. Risks and AI

Any software change may, despite reasonable efforts, cause temporary downtime, incompatibilities, new errors or a need to roll back.

Part of diagnosis/repair proposals may use AI systems. AI can be wrong; we do not guarantee any proposal is the only or best fix. See the “AI & automation” page.

8. Third parties

We are not responsible for third-party changes or outages (WordPress, WooCommerce, plugins, themes, hosting, payments, CDN, DNS, APIs, SaaS, etc.), nor for third-party updates or interventions after a fix is completed.

9. Same-issue follow-up

Beyond No Fix, No Charge at deploy time: if the same technical issue we fixed reappears within 30 days without new changes by you or third parties (updates, new plugins, server changes, etc.), you may open a related Job and we will review it without an extra repair fee for that same cause, within reason.

New/different issues and consequences of third-party updates are not covered.

10. Outcomes and liability cap

We provide technical remediation; we do not guarantee sales, SEO, uptime, speed or business results.

To the maximum extent permitted by law, our total liability for a given Job is limited to the amount you paid for the relevant service on that Job. We are not liable for indirect or consequential damages except where such limitation is prohibited by mandatory law.

11. Data, confidentiality, IP

Personal data processing is described in the Privacy Policy and, where applicable, the DPA.

We keep non-public information confidential (code, credentials, business data) and use it only to deliver the service.

You retain rights in your code and content. We retain rights in the OpDesk platform, automations, tools and general methods.

12. Refusal / suspension

We may refuse or stop work if authorization is missing, risk is material, use is unlawful, or the request exceeds the agreed / safe scope.

13. Governing law

These Terms are governed by the laws of Greece, subject to mandatory rules. Disputes: courts of Athens, subject to mandatory consumer jurisdiction.

If any provision is invalid, the remainder stays in effect.
